What can I do if I am having problems with my pension benefits?

Private Sector Employees

· The Employee Retirement Income Security Act of 1974 (ERISA) protects the interests of participants and their beneficiaries who depend on benefits from private employee benefit plans. ERISA sets standards for administering these plans, including a requirement that financial and other information be disclosed to plan participants and beneficiaries, in addition to requirements governing how benefit claims are processed within these plans.

· The U.S. Department of Labor, Employee Benefits Security Administration (DOL, EBSA) is the Federal-level agency tasked with enforcing the provisions of ERISA.

· If you are experiencing problems, or just have a question about your employer-sponsored pension plan, contact your nearest EBSA Regional Office.

Federal Employees

· The Office of Personnel Management (OPM) provides retirement, survivor, disability, and death benefits to most employees of the Federal government. For information related to the retirement of a Federal employee, contact OPM's Retirement Information Office.

State or Local Government Employees

· If you are an employee of a state or local government and are experiencing problems with your pension plan, we recommend speaking with your agency's personnel department or State Department of Labor for guidance and referrals to the appropriate office, as these vary by state and locality.
